During this masterclass, James Ward and Jemma Garside from the Private Client team at Kingsley Napley unpicked the two legal tools that can be used to make decisions and manage the affairs of someone who has lost the ability to do so themselves. They defined the term “mental capacity” and the grey area surrounding this, and looked at common issues that arise, particularly with blended families.
